PART X - DISTRIBUTION AND SUPPLY OF ELECTRICITY


Part X of the Electricity Act 2023 comprises sections 113 to 115. Its purpose is to ensure that electricity distribution and supply are reliable, fairly managed, and that consumer rights are protected.

Highlights of the three sections are:



Promotion and Review of Renewable Energy
  • Promotion: The Commission and the ISO are obligated to promote the distribution of electricity from renewable sources.
  • Biennial Review: Every two years, the Commission assesses whether:
    • Adequate power sources are secured through long-term and medium-term agreements.
    • The distribution system is maintained in good condition for reliable supply.
    • Consumer complaints are addressed promptly.
Distribution Use of System Agreement
  • Non-Discriminatory Access: Consumers within a distribution licensee's area can enter agreements to receive electricity from other sources, with the distribution licensee acting as a common carrier providing open access.
Consumer Grievance Redressal
  • Separate Forums: Distribution and supply licensees must establish forums for consumer grievance redressal. In areas with multiple licensees, joint forums may be established.
  • Complaint Resolution: Consumers can file complaints for redressal, and licensees must resolve them within a specified time frame. If unresolved, the Commission will mediate and resolve the issues.
Metering and Compliance
  • Mandatory Metering: Licensees must supply electricity through proper meters as regulated by the Commission.
  • Compliance and Enforcement: The Commission may order corrective actions for non-compliance. Consumers are responsible for accepting meter installations, and non-compliance can result in disconnection.
Payment Obligations
  • Mandatory Payment: Customers must pay electricity bills, and failure to pay can result in disconnection.
  • Recovery of Arrears: Provisions allow for the recovery of unpaid electricity charges. Pre-paid meter users with defective meters will be billed based on
previous average usage.
  • Non-transferability of Debts: New landlords or tenants are not responsible for the previous occupants' unpaid electricity bills.
